A l’occasion de la sortie de deux ouvrages récents, le Commentaire article par article du Pacte international relatif aux droits économiques, sociaux et culturels (Economica, Paris) sous la direction d’Emmanuel Decaux et d’Olivier De Schutter et la 3ème édition du traité International Human Rights Law d’Olivier De Schutter (Cambridge University Press), leurs auteurs aborderont les défis liés au respect et à la promotion des droits économiques, sociaux et culturels (DESC).
L’entrée en vigueur en 2013 du Protocole facultatif se rapportant au Pacte international relatif aux droits économiques, sociaux et culturels (PIDESC) contribue de manière significative à la protection de ces droits, au même titre que ceux garantis par le Pacte international relatif aux droits civils et politiques. En parallèle, les dérégulations sociales et les contestations populistes se multiplient.
Pour autant, il ne faut pas négliger l’influence des deux Pactes sur les jurisprudences nationales mais aussi au niveau régional et dans le cadre onusien, avec le développement progressif du droit international. Le défi actuel est de préserver l’universalité, l’indivisibilité et l’effectivité des droits ainsi garantis face au risque de dérégulation, qui va de pair avec la mondialisation, et à la menace de l’unilatéralisme juridique, lié au repli identitaire.
